1.Nature of Relationship
TheZenCrew App is a technologyplatformthat enables drivers (“Partners”, “you”) to receive riderequests from passengers using the ZenCabs platform.
Driversusing the ZenCrew App act as:
Independent contractors, or
Fleet partners, or
Drivers operating ZenCabs-owned or leased vehicles,
dependingon the applicable service model.
Nothingin these Terms shall be construed as creating an employer–employeerelationship,agency, joint venture, or partnership between ZenCabs and the driver,unless expressly stated in a separate written agreement.
2.Eligibility & Onboarding Requirements
Toaccess the ZenCrew App, you must:
Be at least 18 years of age
Hold a valid driving licence
Possess a valid vehicle registration, insurance, permits, and fitness certificate (where applicable)
Complete identity and background verification as required by law
ZenCabsreserves the right to approve, reject, suspend, or revoke accessbased on verification outcomes or regulatory requirements.
3.Account Registration & Security
You are responsible for maintaining the confidentiality of your login credentials
You are responsible for all activity conducted through your account
You must notify ZenCabs immediately of unauthorized access or misuse
ZenCabsshall not be liable for losses resulting from account misuse due todriver negligence.
4.Use of the Platform
Driversagree to:
Accept and complete rides in a professional and lawful manner
Follow all traffic laws and local regulations
Maintain vehicle cleanliness and roadworthiness
Treat passengers respectfully and professionally
Driversmay choose to accept or decline ride requests, subject to performancestandards and platform policies.
5.Earnings, Payments & Engagement Models
ZenCabsmay operate under multipledriver engagement models,depending on the vehicle ownership structure, location, andoperational requirements.
Thesemodels may include:
Independent drivers or fleet partners, operating on a commission or revenue-sharing basis
Drivers operating ZenCabs-owned or leased vehicles, who may be engaged as salaried employees on ZenCabs’ payroll, subject to separate employment agreements
Hybrid or pilot models introduced from time to time
Accordingly:
Earnings, payouts, incentives, commissions, or salaries shall be governed by the applicable engagement model
For independent drivers or partners:
Earnings are calculated per completed trip
ZenCabs may deduct platform fees, commissions, penalties, incentives adjustments, or statutory charges
Drivers are responsible for applicable taxes and filings
For salaried drivers employed by ZenCabs:
Compensation, benefits, duties, and deductions shall be governed by a separate employment agreement, company policies, and applicable labour laws
Payoutschedules, settlement cycles, and applicable terms will becommunicated through the App or through separate written agreements,as applicable.
ZenCabsdoes not guarantee minimum earnings or ride volume unless expresslystated in writing.
6.Ratings, Performance & Complaints
Drivers are subject to passenger ratings and feedback
Consistently low ratings, complaints, or safety concerns may result in warnings, suspension, or deactivation
ZenCabs reserves the right to investigate complaints and take appropriate action
7.Prohibited Activities
Driversmust not:
Engage in abusive, violent, or unlawful behavior
Manipulate fares, trips, or GPS data
Accept rides outside the platform using ZenCabs leads
Carry illegal, hazardous, or prohibited items
Use fraudulent practices, including fake trips or payment manipulation
Violationmay result in immediatesuspension or permanent deactivation,without notice.
8.Safety, Accidents & Insurance
ZenCabsoperates under multipleservice and vehicle ownership models.Accordingly, responsibility and insurance coverage may vary dependingon the applicable model for a particular trip.
A.ZenCabs-Owned or Leased Vehicles
Vehicles owned or leased by ZenCabs are operated in accordance with applicable laws and internal safety standards
Drivers operating such vehicles may be engaged as salaried employees or under contractual arrangements
Applicable vehicle insurance is maintained in accordance with statutory requirements
ZenCabsshall manage insurance coverage for such vehicles as required by law;however, ZenCabs does notprovide personal accident or health insurance to passengers,unless expressly stated otherwise.
B.Commission-Based / Partner Vehicles
Vehicles operated by independent drivers or fleet partners remain the responsibility of the respective owner or operator
Such drivers or partners are solely responsible for:
Vehicle condition and maintenance
Valid insurance coverage
Compliance with permits and transport laws
ZenCabsacts solely as a technology platform in such cases and shall not beliable for accidents, injuries, damages, or traffic violationsarising during trips.
9.Limitation of Liability
Tothe maximum extent permitted by law:
ZenCabs shall not be liable for indirect, incidental, or consequential damages
ZenCabs is not liable for loss of income, business opportunities, or goodwill
Total liability, if any, shall not exceed platform fees earned by ZenCabs from the relevant trip
10.Service Disclaimer
TheZenCrew App is provided on an “asis”and “asavailable”basis. ZenCabs does not guarantee uninterrupted or error-free access,including GPS accuracy, network availability, or ride availability.
11.Suspension & Deactivation
ZenCabsmay suspend or permanently deactivate driver access for:
Violation of these Terms
Fraudulent or unsafe behavior
Repeated complaints or low ratings
Legal or regulatory requirements
Deactivationdecisions are final unless otherwise required by law.
Whererequired under applicable law, ZenCabs may provide a limited reviewor appeal mechanism for deactivation decisions. Nothing herein shallbe construed as creating an obligation to reinstate access orcontinue the engagement.
